1. General provisions.

1.1. This document, addressed to any legal entity or individual who has reached the age of 18 years (hereinafter referred to as the Guest), is an official, public and irrevocable offer of LLC "APART CITY" (Apartment Booking Service in Moscow-City MMDC), hereinafter referred to as "Agent", acting on the basis of the Charter, to conclude contract for the provision of daily apartment rental services using an Internet resource / (hereinafter referred to as the Site).

1.2. In accordance with paragraph 3 of Article 438 of the Civil Code of the Russian Federation, the acceptance of the essential conditions contained in this offer is, in accordance with paragraph 1 of Article 438 of the Civil Code of the Russian Federation, an acceptance and is equivalent to the conclusion of a contract for the provision of daily apartment rental services, as well as the provision of additional services, in accordance with the request of the Guest, on terms and conditions, provided for by this Agreement.

1.3. The full and unconditional acceptance (acceptance) of the terms of this offer is considered to be the payment made by the Guest for accommodation in the ordered apartments and the receipt by the Agent of the corresponding financial document confirming the fact of payment. The Agent issues the Guest a document confirming the placement, on the letterhead of the organization, which specifies all the essential conditions of the order (hereinafter referred to as the Check-in Form).

1.4. If the Guest does not agree with this Agreement, the Guest has the right to refuse to accept the Offer Agreement and conclude an agreement with the Agent in writing, or refuse to use the booking services.

2. The subject of the offer.

2.1. The subject of this Offer Agreement is the provision of daily apartment rental services by the Agent to the Guest in accordance with the terms of this Agreement. Daily apartment rental services (hereinafter referred to as Booking) in the sense of this Agreement (non - living space) means the following: apartment booking services, consulting, information and other services specified in the Check–in Form and necessary for Guest service. Registration in apartment is impossible according to Russian Law, it can not be used as a place for living residence, temporary or permanent.

3. Rights and obligations of the parties.

The agent guarantees the Guest the full legal right to rent the apartment. The apartments are free from any third party claims.

3.1. The Agent undertakes:

3.1.1. No later than 3 working days from the date of receipt of the order, confirm the possibility of providing the Reservation to the Customer with an indication of its cost.

3.1.2. To book apartments and provide services included in the price of the order; to issue documents giving the Guest the right to receive the ordered services and to transfer copies of these documents in electronic form to the Guest.

3.1.3. Eliminate all problems in the premises that arise through no fault of the Guest, keep the apartments and the equipment installed by the Agent in good condition. In case of any malfunctions, emergencies or threats of their occurrence in the premises, the Agent undertakes, within a reasonable time, to take the necessary measures to eliminate them.

3.1.4. If it is impossible to provide the Booking Service on the terms stated by the Guest, inform the Guest about it and offer the booking on alternative terms.

3.1.5. Give the Guest a set of keys to the entrance doors to the apartment and elevators at the time of arrival at the apartment.

3.1.6. Notify the Guest in a timely manner about all situations requiring additional approval.

3.1.7. The Service is considered to be properly provided by the Agent in case of the Guest's check-in to the selected apartment, full or partial payment for accommodation, as well as in case of refusal of it at the initiative of the Guest, or non-check-in.

3.1.8. The Agent has the right to check the order of use of the apartments and their condition in the presence of the Guest. In exceptional cases requiring immediate intervention, the Agent reserves the right to visit the apartment without prior agreement with the Guest, including at the time of the Guest's absence from the apartment.

3.1.9. The Agent has the right to withhold from the Guest a fine of 10,000 (ten thousand) rubles in case of violation by the Guest of the smoking ban in the apartment and a fine of 10,000 (ten thousand) rubles for smoking in public areas.

3.1.10. If the Agent does not receive full payment for the ordered services within the agreed period or before the arrival date specified in the Check-in Form, the Agent has the right to cancel or change the reservation at its discretion, notifying the Guest. At the same time, the Agent reserves the right to withhold an advance payment in order to compensate for its losses and actually incurred costs associated with the fulfillment of obligations under this Agreement

3.1.11. The Agent has the right, if the Guest does not comply with any of the points of this offer, to refuse the Guest further provision of Services.

3.1.12. The Agent is not responsible for valuables left by the guest.

3.1.13. Parking is available only upon prior request, subject to availability. Availability must be confirmed at least one day in advance. Parking is subject to availability due to limited parking spaces and may already be booked for your dates of stay.

3.2. The Guest undertakes:

3.2.1. After reviewing the tariff plans and provisions of this offer posted on the Website, make an application by filling in the necessary fields in the booking form indicating all the necessary reliable information about yourself and the end users of the Service, displaying specific wishes about the category of apartments, the number of apartments to be booked and the terms of their use. The application can also be made by the phone numbers mentioned in this offer, by e-mail or on-line.

3.2.2. Make payment for the Reservation within 72 hours from the moment of confirmation of the application on the basis of the confirmation received from the Agent - by cashless payment on the Website, or by cash payment at the Agent's location. Send the Agent the documents confirming the payment immediately within 24 hours, notify the Agent of the action taken.

3.2.3. Observe the fire safety rules, the rules for staying in the apartments and the rules for staying in the common areas of the complex, established by the administration.

3.2.4. Immediately inform the Agent about the occurrence / threat of any malfunctions or emergency situations in the apartment. In case of leaks of water supply systems, sewerage, problems with electricity supply, the Guest undertakes to inform the Agent about the problems within 1 hour, otherwise the Agent is released from responsibility and responsibility for all damage caused to the apartment and adjacent premises lies entirely with the Guest.

3.2.5. To ensure the safety of the apartments and the Agent's property and to maintain the apartments in proper condition. In case of damage to the apartment or the Agent's property due to the Guest's fault, the Guest undertakes to reimburse the Agent for the cost of repairing or replacing the damaged property, taking into account natural wear and tear. In case of theft of the Agent's property, the Guest undertakes to reimburse the full value of the lost property. The Guest, throughout the entire rental period and the validity of this agreement, regardless of the actual location of the Guest, is fully responsible for the safety of the Agent's property.

3.2.6. Use the apartment exclusively for the purposes stated by the Guest initially and agreed with the Agent in advance.

3.2.7. Vacate the apartment no later than the expiration of the rental period specified in the Check-in Form. Check-in is at 15:00, check-out is at 12:00.

3.2.8. At the moment of the apartment's release, return to the Agent all sets of apartment key cards handed over to the Guest. In case of loss of a set of key cards, the Guest is obliged to pay a fine of 3,000 (three thousand) rubles for each lost key. Cleaning after the events is paid from a deposit of 10,000, or at the discretion of the lessor. When leaving, the garbage must be packed in bags. Cleaning of unpacked garbage and surface pollutants (wax, candy, flower petals, spilled drinks, etc.) it is not included in the price and is paid based on the amount of additional cleaning.

3.2.9. Not to sublet the apartment to third parties.

3.2.10. Do not violate public order, do not make noise, do not turn on loud music, TV and other noisy devices from 23.00 to 09.00.

3.2.11. Do not smoke on the entire territory of the apartment, as well as on the territories adjacent to them, with the exception of places designated by the Agent.

3.2.12. The Guest has the right to change or cancel the Reservation free of charge by sending a corresponding notification to the Agent no later than 7 (seven) days before the start date of the stay. The cancellation application must be submitted in writing and signed by the Guest. Cancellation of the booked services by phone or verbally is not a reason for free cancellation of the Reservation. In case of cancellation less than 7 (seven) business days in advance or no-show, the full cost of the stay will be charged, and the prepayment transferred is non-refundable.

3.2.13. The Guest has the right to extend the rental period on the terms and exclusively in agreement with the Agent, notifying the Agent no later than 1 (one) day before the end of the rental period.

3.2.14. Access to the apartments is possible only with original identity documents for everyone, with single-use cards, which are registered by the management company. It is not possible to let more people into the apartment than the number of people stated in the reservation and provided by the apartment. Minor guests can stay in the tower only in the presence of parents with the obligatory presentation of the original birth certificate.

3.2.15 At least a day in advance to coordinate with the Agent the carrying of oversized items into the apartment (an item is considered oversized if one of the measurements exceeds 1 meter (length, or height, or width)) due to the special mode of operation of freight elevators.

3.2.16 All guests and visitors must provide their data for ordering passes one day in advance - full name and series number of the original identity document, the original of which will be used to enter the tower. Access is possible strictly for the number indicated in the apartment description.

4. Financial relations of the parties.

4.1. The cost of Booking and the amount of prepayment in the apartment is negotiated with the Agent separately and may change up or down, depending on the season, the duration of the Reservation, the number of people staying, the purpose of using the apartment and other conditions.

4.2. The cost of Booking in the apartments chosen by the Guest is paid upon arrival, in the amount specified in the Booking confirmed by the Agent, minus the prepayment made.

4.3. After the prepayment has been made, the Guest has the right to demand a full or partial refund of the funds paid to the Agent, no later than 7 (seven) working days before arrival. This requirement is made in writing, in any form or through the Website.

4.4. In the case of a written request by the Guest for a full refund of the funds paid for the Reservation, the refund is made only if the request is actually received by the Agent in writing no later than 7 (seven) days before the date of arrival. During the "high dates" (the period of New Year and Christmas holidays (from December 25 to January 14), festivals, sports competitions (Olympiads, Championships), special booking and cancellation conditions are possible.

4.5. In case of early termination of the stay in the apartment, the cost of unused services by the Guest is not reimbursed.

4.6. The Apartment is provided to the Guest when the Deposit is handed over for the entire period of use of the Apartment. The Deposit is returned to the Guest in 3 - 7 days after the end of the rental period of the Apartment, due to the fact that the Managing Company provides a list of lost elevator cards within 2 working days. Refund is made through the quick payment system - transfer to the phone number from which the request for the reservation was received, unless otherwise specified in the comment to the reservation or agreed in writing or sent by messenger/email or other contacts listed on the website.

4.7.The Agent has the right to withhold the Deposit in case the Guest does not pay for additional paid services, the cost of damaged, damaged or lost property, keys (cards), fines for non-compliance with the rules of use of the Apartment, fire safety and sanitary rules.

The Agent, without obtaining additional consent of the Guest, has the right to debit amounts from the Guest's bank card without acceptance (to transfer funds):

- rent for the use of the Apartment, other payments, incl. fines, penalties, amounts of losses, incl. amounts owed by the Guest to the Agent, as well as for any other obligations arising from damage and other grounds provided for by the legislation of the Russian Federation, as well as the amount of compensation for the Agent's expenses incurred by the Agent due to actions (inaction) A guest.

4.8. Funds are debited when the Agent has grounds for debiting them. The guest is notified of the fact that funds have been debited to compensate for losses, fines, penalties.

4.9. The Guest gives unconditional consent to debit funds from his bank card for making payments (including fines and other payments) - in a non-acceptance manner. Write-off of amounts is allowed both in full and in parts at the discretion of the Agent. In case of insufficient funds on the bank card, or the inability of the Agent to debit funds from the bank card for other reasons, the Guest undertakes to pay all necessary payments from the moment of receipt of the relevant notification from the Agent. The guest undertakes to ensure that the balance of funds on the bank card is sufficient for debiting.

5. Rules of events, photo and video production, on the territory of the apartment.

5.1. All events and video filming conducted on the territory of the apartment are charged at least double the cost of the Tariffs published in the Online booking section of the Website.

5.2. When agreeing on the terms of the events, Guests are invited to fill out a questionnaire, according to the results of which, the Agent has the right to set an arbitrary price in agreement with the Guest, based on the description of the event.

5.3. All events and photo and video productions are agreed by the parties to a separate contract for the "Provision of services".

5.4. The Agent has the right to request a deposit amount as security for the obligations assumed by the Guest under the "Provision of services" agreement.

6. Responsibility of the parties and dispute resolution procedure.

6.1. For non-fulfillment and /or improper fulfillment of obligations under this offer, the parties are responsible in accordance with the current legislation of the Russian Federation.

6.2. The Agent is not liable in case of non-performance or improper performance of the Service on his part or on the part of third parties, arising from the unreliability, insufficiency or untimeness of the confirmed information and documents provided by the Guest, as well as arising from other violations of the terms of this offer on the part of the Guest.

6.3. The Agent is not responsible in case of non-arrival of the Guest in the paid apartment on the first day of arrival, and as a result, possible non-occupancy in them.

6.4. The Agent is not responsible for the inconsistency of the provided service with the expectations of the Guest and his subjective assessment.

6.5. The Agent is released from liability for full or partial non-fulfillment of obligations stipulated by this offer, if this non-fulfillment was the result of force majeure circumstances that arose after the conclusion of this agreement, as a result of extraordinary events that the parties could neither foresee nor prevent by reasonable measures (force majeure).

6.6. Disputes arising during the execution of this Agreement on the terms specified in this offer are resolved through negotiations between the parties or in a claim procedure. If disputes and disagreements between the parties are not settled through negotiations, they are subject to settlement in court at the location of the Agent.

6.7. The Agent is not responsible for the illegal actions of the Guest.

6.8. The Agent is not responsible for the data and information stored, transmitted and received through any equipment installed in the apartment. Internet access is provided via an open wireless network without a guarantee of confidentiality of the transmitted or received information, including by third parties.

6.9. The Agent disclaims responsibility if, by the decision of the authorities or responsible persons, the Guest was denied the opportunity to stay in the reserved apartment (accommodation facility) for the following reasons: violation of law and order or causing concern to others, alcohol or drug intoxication or violation of other rules of public behavior, storage, transportation or distribution of drugs, illegal storage of weapons, etc. etc .; incorrect registration of personal documents (absence of a record of family members in the Guest's passport, absence or incorrect registration of powers of attorney for minor children, etc.).

6.10. In case of violation of this agreement by the Guest, the Agent has the right to evict the Guest from the apartment without refund of the Reservation cost.

6.11. The Guest's refusal of any services during the stay does not give the Guest the right to receive compensation for unused services. The same condition applies to cases when the Guest is late for arrival at the apartment indicated in the Check-in Form.

6.12 Check-in to the apartment and key collection is carried out with a guest who has reached the age of 21.

7. Other conditions.

7.1. This offer and the check-in form are an integral part of this agreement.

7.2. The Contract is considered concluded from the moment the Agent receives the documents confirming the Guest's payment for the Reservation and is valid until the parties fulfill their obligations.

7.3. By making a payment, the Guest confirms that he has read and accepts the terms of the contract-offer for the provision of daily apartment rental services. Credit cards are accepted for payment: VISA CARD, MASTER CARD, AMERICAN EXPRESS.

7.3. In everything else that is not provided for in this offer, the parties will be guided by the current legislation of the Russian Federation.
